The "SOUND OF VIENNA" Konzertveranstaltungs GmbH ("We") organizes classical music concerts and cultural events at various historic Viennese venues (e.g., Kursalon, Konzerthaus, Hofburg, Musikverein). We handle ticket sales exclusively for these events. These terms and conditions govern the contractual relationship between you as the buyer and us as the seller concerning ticket purchases for these events on our website.

Conclusion of Contract, Binding Effect
Your order for event tickets from Sound of Vienna is considered an offer to conclude a contract. This offer becomes binding once you click the [Buy Tickets] button on our website. Before clicking this binding contract offer button, you will have the opportunity to correct any errors in your order during the ordering process. We accept your offer by sending an order confirmation along with the invoice to the email address you provided during the ordering process. You will receive either the order confirmation or a notification of unavailability within 48 hours of your order. If you do not receive a response within this time frame, please inform us at sound@soundofvienna.at. If you still do not receive a response within the next 24 hours, you are entitled to cancel your order at no cost by emailing us at the above address.
Event, Changes, Prices
The information about the content of each concert or the services provided, as stated on our website, reflects the actual content or services provided according to the planning status at the time of document creation. This information is not binding. Operationally necessary, minor changes are permitted and do not entitle you to cancel the contract or claim damages, provided these changes do not fundamentally alter (especially worsen) the character of the event and are reasonable for you as a customer.
We reserve the right to change the event location for important reasons, ensuring that the new venue is comparable in accessibility and ambiance to the Kursalon Vienna. We will inform you of any such changes via email to the address provided during the ordering process. Purchased tickets remain valid for the new venue.
The prices listed on the order form on our website are total prices and include statutory VAT.
All prices are quoted in EURO.
Effectiveness of the Contract, Order Confirmation
Your order becomes legally binding with our order confirmation (see above) and obliges you to pay the ticket price. A subsequent cancellation is not possible.
You must check the order confirmation immediately upon receipt. Any discrepancies from the order should be reported to us immediately (preferably in writing, including email).
Upon presenting this order confirmation at the evening box office of the respective concert, you will receive your final ticket.
The order confirmation must not be duplicated, and we do not assume liability for loss after delivery. Tickets may not be resold without our consent.
If you provided an email address when ordering, the order confirmation is considered received upon delivery to that address. It is your responsibility to ensure that any spam filters or similar settings allow the order confirmation to be delivered.
No replacement will be provided for tickets that are not used or only partially used.
Right of Withdrawal under the Distance and Outward Transactions Act (FAGG)
The right of withdrawal according to §18 Abs.1 Z10 FAGG does not apply to "services related to leisure activities if the contract provides for a specific date or period for performance." Therefore, there is no right of withdrawal for the present contract between you as the buyer and us as the seller.
Appropriate Clothing; Proper Conduct
Admission to the event is granted only to individuals dressed appropriately. We have the right to refuse entry or exclude individuals from the event who are visibly intoxicated or behaving inappropriately. In such cases, there is no entitlement to a refund of the ticket price.
Seating Allocation
Within the category you have booked, there is free seating at concerts. Please note that it is not always possible for guests attending as a pair or group to receive adjacent seats. Sound of Vienna reserves the right to allocate seats within the booked category.
Liability
We are liable for personal injuries caused by us and for property damage in cases of intent or gross negligence on our part or by persons attributable to us. We are not liable for slight negligence unless it concerns a primary contractual obligation.
In the event of a cancellation, the ticket price will be refunded. However, we are not liable for any further damages, especially travel costs, unless the cancellation was caused by our gross negligence or intent.
Payment; Conditions for Credit Card Payment
Payment is made by credit card (Visa or MasterCard/Eurocard), with all transactions and order information encrypted and protected from third-party access. Your credit card will be charged immediately after the order confirmation is sent.
Payment processing is handled not by us but by a specialized and licensed service provider (Bókun, Stripe) in cooperation with the respective credit card companies. All data provided by the customer during the payment process (especially credit card data) are transmitted directly to this service provider or the respective credit card companies.
Data Protection
The personal data you provide to us during the purchase process will be stored and electronically processed by us. Data handling complies with the GDPR. Further details can be found in our privacy policy.
Contract Language
The available languages for contract conclusion are German and English.
Place of Performance/Jurisdiction; Legal Notices
Austrian law applies (excluding its international referral norms and the UN Sales Convention). The place of performance is Vienna. The court of jurisdiction for all business relations with entrepreneurs and consumers without a residence or habitual place of abode in a European Economic Area (EEA) member state, or who move their residence and habitual place of abode to a non-EEA state after the contract is concluded, is the competent court for Vienna, Inner City.
If you are a consumer with a residence/habitual place of abode within the European Union or an EEA member state, the competent court for your residence/habitual place of abode is applicable. However, you may also bring legal action against us at the previously mentioned court.
Please note that there is a statutory warranty right for the purchased tickets according to §§922ff ABGB.
